A notice of appeal against the new state construction guidelines was submitted by three counties on Thursday.In court filings, Cape May, Ocean, and Monmouth counties argued that the state Department of Environmental Protection lacked the power to impose the rules, calling them “unreasonable, arbitrary, and capricious.”On Thursday, a DEP representative chose not to comment. The department usually doesn’t comment on lawsuits.
